These Terms of Service (“Terms”) govern your use of the mobile games (including Marble Sudoku), applications, website, and related services (collectively, the “Services”) provided by Luma Play UG (haftungsbeschränkt) (“Luma Play”, “we”, “us”, or “our”).

1. Eligibility

  • You must be at least 13 years of age to use our Services.
  • If you are under 18, you must have permission from a parent or legal guardian who agrees to these Terms on your behalf.

2. In-App Purchases and the “EU Right of Withdrawal”

While our general policy is that purchases are non-refundable, we strictly adhere to European consumer protection laws.

  • General Rule: All purchases of virtual items or currency (“Virtual Items”) are final.
  • EU/EEA/UK Withdrawal Right: If you reside in the EU, EEA, or UK, you have a statutory right to withdraw from a purchase within 14 days without giving any reason, provided the Virtual Items have not been used or consumed.
  • Loss of Right: Once you access or use the Virtual Item, you acknowledge that you lose your right of withdrawal.
  • Execution: All transactions are handled by the Google Play Store or Apple App Store. Refund requests must be directed to their respective support channels.

3. User Conduct and Third-Party Services

  • Unity Services: Our games integrate Unity LevelPlay, Unity Analytics, and Unity Ads. Your use of these features is also subject to Unity’s Terms of Service.
  • Prohibited Activity: You may not use cheats, automation software (bots), or hacks. Engaging in activity that disrupts the game for others is grounds for immediate account termination.

4. Data Deletion and Account Termination

  • We reserve the right to terminate your access to the Services at any time for violations of these Terms.
  • Data Privacy: Upon termination, your data will be handled according to our Privacy Policy. You may request the deletion of your online data at any time via: https://luma-play.com/data-deletion/.

5. Dispute Resolution and Governing Law

  • Governing Law: These Terms are governed by the laws of Germany.
  • Venue: For commercial disputes, the competent courts of Essen, Germany, shall have exclusive jurisdiction.
  • Consumer Rights (EU): If you are a consumer in the EU, you may also bring disputes to the courts of your place of residence. You have access to the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr.
